Electronic Communications Disclosure
1. For customers who applied for a credit card after October 28, 2026.
For customers who applied before that date, please refer to Section 2 below.
Consent to Receive Documents Electronically: You consent to Capital One providing the following documents (“documents”) to you electronically:
- applications for your account and any related forms;
- interest rates, fees and other items mentioned in the disclosure statements we send to you from time to time with respect to your account;
- your agreements and any changes to your agreements;
- statements for your account;
- this Consent and any changes to this Consent; and
- any other confirmation, notice or information we are required by law to provide to you in writing.
When Consent Takes Effect: Your consent for electronic delivery of documents takes effect immediately after you agree to this Consent, but you may continue to receive paper documents by mail for some time.
Paper Documents: We may provide you with documents by mail if we consider it appropriate or if we are unable to provide them electronically, including where documents are not currently in digital form. Any paper delivery will be provided to you at the most current mailing address that we have on file for your account. You may also contact us to request a paper copy of your documents.
Verbal Consent: If you verbally consented to Capital One providing you documents electronically, this confirms your consent. If you do not agree to these terms and conditions, you may revoke your consent as described below under “Revoking Consent”.
Electronic Delivery of Documents and Availability: When we provide a document electronically, we will do so by making it available to you through email or Capital One Online Banking (“Online Banking”), which can be accessed at capitalone.ca.
We will make account statements and other documents except for those set out below, available electronically through Online Banking and you may access them for 7 years after they are posted. Notifications may appear on the account statements themselves. We may send you email notifications when you have a new document available through Online Banking.
Other documents may be delivered to you as follows:
- We may send you email notifications regarding balance alerts advising you that you are approaching a predetermined balance/credit limit on your applicable account.
- We may send you an email with the welcome kit components, including the Cardholder Agreement, the Benefits Booklet and the Rewards Booklet (if applicable), made available as one or more links to capitalone.ca. These documents will be retained for a period of 7 years from the date of your consent and made available to you at your request.
- We may send you an email with a copy of this Consent, including to confirm any oral consent, by making it available as a link to capitalone.ca. These documents will be retained for a period of 7 years from the date of your consent and made available to you at your request.
- We may present you with documents, or a link to documents, when you sign into Online Banking or as part of an online transaction or online selection. These documents may only be available at the time they are presented to you, and you should save a copy for your records.
Emails will only be sent if you have provided us with your email address. Any emails we may send to you will remain available to you unless the email is deleted by you or your service provider, or you no longer have access to your email account. You should check your junk/spam email folders to ensure that no emails from us have been sent there by your service provider.
You are responsible for printing or downloading a copy of any document for your records.
Accessing Online Banking: To access your documents through Online Banking, you will need to create credentials and sign into Online Banking. Until you set up this access, your statements and other documents will continue to be provided by mail, except for those documents designated in this Consent to be sent to the email address we have on file. If you are unable to access Online Banking for any reason, you should revoke your consent as described below under “Revoking Consent”.
Accessing Email: You must open an email from Capital One at least once over a 12-month period in order to continue to receive emails from Capital One. If you don’t open an email from Capital One at least once over a 12-month period, we will stop sending documents to your email address that were designated to be sent to your email address in this Consent.
Contact Information: You are responsible for keeping your contact information, including your email address, up to date to ensure you receive your documents electronically and/or in paper. If you fail to update or change an incorrect email address or other contact information or fail to open at least one email from Capital One within a 12 month period, you understand and agree that any communications shall nevertheless be deemed to have been provided to you if they were made available to you in electronic form in Online Banking, or emailed to the email address we have for you in our records.
Revoking Consent: If you would like to revoke your consent for electronic delivery, you can change your preferences in your Online Banking, or by contacting us as specified on our Contact Us page. You may still receive electronic delivery of documents issued by us before your revocation takes effect.
Hardware and Software Requirements: To enable you to access and retain your documents electronically, you must have access to equipment that meets the hardware and software requirements described under the Browser FAQs (linked here). If, in the future, you no longer have access to equipment that meets our hardware and software requirements, you must revoke your consent as described above under “Revoking Consent”.
Updates to Delivery Methods: We may update our electronic delivery processes or systems from time to time. If we change how your electronic documents are delivered, we will notify you in advance. If you do not wish to continue receiving documents electronically under the updated process, you may revoke your consent at any time as described in the “Revoking Consent” section above.
Changes to this Consent: We may change the Terms of this Consent from time to time including changes to electronic delivery methods, document availability periods, hardware, software and access requirements, and contact information obligations. Where required by law, we will provide you with notice of any change in writing at least 30 days before the change takes effect. Our notice will specify (a) the date the change takes effect; (b) the old section and the newly amended section or just the newly amended section; and (c) your right to refuse the amendment and revoke this Consent without cost, penalty or cancellation indemnity by sending us a notice to that effect no later than 30 days after the amendment comes into force, if the changes increase your obligations or reduces our obligations. The amended terms of this Consent will apply starting on the date the change takes effect, including during the 30-day period in which you have the right to refuse the amendment. If you do not send us notice refusing the amendment or revoking your Consent within thirty (30) days after the amendment comes into force, you will be deemed to have accepted the amendment. If you choose to refuse the amendment within that 30-day period, your Consent will be revoked as described under “Revoking Consent” without cost, penalty, or fee. Where permitted by law, the notice of any change to this Consent will be made available through Online Banking.
Applicable to Quebec Residents Only: This Consent is available in both French and English language versions. You hereby confirm that you have requested that this Consent and all related documents be drafted in English and that you have been provided with a French language version of this Consent and that you agreed to be bound by the English language version of this Consent. Ce consentement est disponible en français et en anglais. Par la présente, vous confirmez avoir demandé que ce consentement soit rédigé en anglais, que vous avez reçu une version française de ce consentement et que vous avez accepté d'être lié par la version anglaise de ce consentement.
2. For customers who applied for a credit card before October 28, 2026
For customers who applied for a credit card before October 28, 2026, this consent was included in the Terms and Conditions for Capital One Online Banking Service as Section 6 (Electronic Communications Disclosure) and remains in effect as outlined below.
Please read this Electronic Communications Disclosure (“eCommunications Disclosure”) thoroughly – it contains important information about your legal rights.
Your Legal Rights
Certain laws require us to provide specific information to you in writing, which means you have a right to receive that information on paper. We may provide such information to you electronically if we obtain your consent to this eCommunications Disclosure, which includes your consent to receive such information in electronic form. Your consent will also apply to any other person named on your account, subject to applicable law.
At times, we may still present you with paper disclosures or other documents that contain important information about your account, and you should continue to review any correspondence that we mail to you. Any communications that Capital One determines, in its sole discretion, that you should receive in paper rather than electronic form will be mailed to the primary address we show for you in our records or otherwise delivered as required by law or any Additional Agreement.
By consenting to this eCommunications Disclosure, you agree that you have, or have access to, equipment that meets the hardware and software requirements described in the FAQs section of our site to enable you to sign in and use Online Banking and to access and retain your statements, documents and disclosures electronically. If, in the future, you no longer have, or have access to, equipment that meets our hardware and software requirements, please contact us to unenrol from receiving electronic communications. We reserve the right to cancel your participation in this program at any time.
Consent and When It Takes Effect
Your consent for electronic delivery of information includes:
- Periodic statements;
- Any application disclosures (including the required information box) and/or application form and terms provided in connection with your application for any product or service within Online Banking or any other site;
- Any initial disclosure statement (including the required information box) and/or cardholder agreement provided in connection with any Capital One credit card;
- Any notice of amendment (which may include the addition of new terms) to a Capital One cardholder agreement or to the interest rate, fees or other changes applicable under such agreement that Capital One determines, in its sole discretion, to provide in electronic form;
- This Agreement, other service or user agreements for online access to Capital One Websites, all updates and changes to these agreements and all disclosures, notices and other communications regarding Online Banking and transactions you make within Online Banking or through other Capital One Websites;
- Important disclosures and notices relating to the maintenance or operation of an account, product or service including, but not limited to, account information, account activity, account inactivity, payments made or due, or other statements, disclosures or notices that may be required by any applicable laws and regulations;
Your consent shall take effect immediately upon your acceptance to this Agreement. However, processing of your consent may be delayed. Any documents required may continue to be delivered via paper until we complete processing of your consent.
How to Withdraw Your Consent
You can withdraw your consent to receive your statement electronically, with no cost to you, online or by phone. To do so, sign in to Online Banking and update your settings or contact us as specified on our Contact Us page. Your withdrawal of consent is effective only after you have communicated your withdrawal to Capital One by calling the appropriate customer service phone number and Capital One has had a reasonable period of time to act upon your withdrawal. We will confirm that we have received your withdrawal of consent and specify when it takes effect. You will receive this confirmation in writing either in electronic form or in a paper document. Such withdrawal of consent will only apply to those communications that are required by law or regulation to be provided to you in paper form. We may continue to deliver to you in electronic format all other communications. Your consent shall remain in force until withdrawn in the manner provided in this section.
Consent Coverage; Certain Notices from Which You Are Not Covered
You may be required, by contract or applicable law, to give us notice in writing. Your consent here does not relate to those notices, and you must still provide them to us on paper.
Obtaining Copies of Electronic Communications
Your online statements will be available to review at intervals in accordance with your existing statement cycle date. While enrolled, your online statement will be available for 12 months or more, so make sure that you make any necessary copies prior to that time.
We recommend that you print or download a copy of this Agreement, this eCommunications Disclosure and all other communications to retain for your permanent records. Do this when you first review the communications, because after submission we do not necessarily keep them all in a place that you can access.
You may also contact us to request a paper copy of your statement or other communications. We may charge fees for paper copies of your statements or other communications.
Updating Your Contact Information
As a courtesy, when your statement is available online, we will attempt to send an email notification to the address that we have on file. We also may send you an email notification when you have a new other communication available for review. Alternatively, we may communicate the other communication directly through email. You must open an email from Capital One at least once over a 12‑month period in order to continue to receive such notifications.
In the event that your email address or other contact information is changed, you must notify Capital One of such changes immediately through Online Banking. It is your responsibility to update any changes in your email address online, and we are not responsible if you do not receive a courtesy reminder. If you do not receive an email and believe you should have, please verify your email address in Online Banking.
If you fail to update or change an incorrect email address or other contact information or fail to open at least one email from Capital One within a 12‑month period, you understand and agree that any communications shall nevertheless be deemed to have been provided to you if they were made available to you in electronic form in Online Banking, or at another Capital One Website or emailed to the email address we have for you in our records.
